Because long ago, young people had to help their families harvest the summer crops. The schools were often crowded. They thought it would keep children safe from industrial dangers at a time when there were few child-labor laws. /><br />根据昆明市拟制定的《昆明市城市道路车辆通行规定》（以下简称规定），自2009年1月1日起，昆明市新办理注册登记摩托车将不得在本市五华、盘龙、西山、官渡四个区以及呈贡新区城市道路上行驶。自本规定实施之日起一个月后，达到报废条件的摩托车一律报废，不再办理更新手续。根据规定精神，在未来将禁止摩托车在本市五华、盘龙、西山、官渡四区及呈贡新区城市道路上行驶。<br /><br />　　本规定违背宪法赋予公民的权利，损害了广大人民的权益，吁请各级人大、政协、各级政府机构、新闻媒体、公民消费者给予关注，并促使其得以合理解决。<br /><br />　　一、规定“禁摩”不符合我国现有法律　　昆明市“禁摩”严重影响我市27万多辆摩托车的拥有公民的出行，是一个牵涉得很广的问题。选择骑乘摩托车是公民选择代步工具权的基本人权之一，城市道路是用纳税人的钱修建的，属于市民共有的资源，有什么理由只准轿车行驶，不准摩托车上路呢？这是不是侵害了公民的道路使用权？何况选择摩托车作代步工具的一般是收入偏低的平民家庭，允许作为机动车的汽车通行的路段却不允许同为机动车的摩托车通行，体现的是对摩托车行驶人与汽车驾驶者的不平等的对待，实质为对广大摩托车行驶人的歧视，不符合《宪法》第二章　公民的基本权利和义务第三十三条　　中华人民共和国公民在法律面前一律平等。国家尊重和保障人权之规定确立的平等权原则；不符合《中华人民共和国道路交通安全法》第三条 “道路交通安全工作，应当遵循依法管理、方便群众的原则，保障道路交通有序、安全、畅通。”所规定方便群众的原则；不符合《中华人民共和国道路运输条例》“第四条 道路运输管理，应当公平、公正、公开和便民。”所规定的公平公正便民的原则。<br /><br />　　我国的法律规定“公民的私有财产不容侵犯。”摩托车与汽车一样都是个人的私有财产。而城市的道路允许汽车行驶却禁止摩托车通行，在客观上是保护了富人的私有财产而侵犯了穷人的私有财产。城市的道路，允许私家车行驶禁止摩托车通行，于法不容、于情不通。禁摩缺乏法律依据，是人治大于法治的典型。<br /><br />　　允许摩托车的商业买卖，给摩托车发了牌照又收取了相应的税收,养路费,过路过桥费，就表明对摩托车上路行驶的一种许可,但现在又禁止摩托车通行，违反《中华人民共和国消费者权益保护法》第二条 消费者为生活消费需要购买、使用商品或者接受服务，其权益受本法保护；本法未作规定的，受其他有关法律、法规保护。第五条 国家保护消费者的合法权益不受侵害。国家采取措施，保障消费者依法行使权利，维护消费者的合法权益。第六条 保护消费者的合法权益是全社会的共同责任。<br /><br />　　公安部２００１年１０月１日颁布履行的《中国人民共和国机动车登记办法》明确规定，车管所必须在受理之日起三个工作日内给予机动车上牌照，否则要承担相应的法律责任。《昆明市城市道路车辆通行规定》内容“达到报废条件的摩托车一律报废，不再办理更新手续；持有入城准行证的，准行证随之注销；车辆遗失后不再补办和续办牌、证及入城准行证。”显然同公安部《中国人民共和国机动车登记办法》精神相抵触。<br /><br />　　从法律上来说,下位法不能违反上位法,政府行为和文件都不能与全国人大颁布的法律相冲突,从我国颁布的所有政策法规看，没有哪一条规定不允许公民在城市使用摩托车，公民的权利除了法律规定赋予以外，法律没有禁止性规定的，也属公民的权利。这是法律的内载性和公民权利的广泛性所决定的，任何组织或任何人都无权剥夺。《昆明市城市道路车辆通行规定》关于“禁摩”的内容，找不到任何的法律依据，是游离于法律之外的举措。这次的禁摩没有通过人大的讨论通过和市民的听证会就颁布和施行，也是对法律的和市民权利的漠视和侵犯。<br /><br />　　二、“禁摩”理由之商酌　　“禁摩”源自以下理由：第一，摩托车安全性极差，在昆明的交通肇事率占全部交通事故的30%—40%，在个别州市占的比例还更高。这种“肉包铁”的交通工具，无论从自身安全还是他人安全来说，都属于应该淘汰的交通工具。其二，摩托车使道路资源不能充分利用，比如，一辆摩托车停在路中间，占用2米长的路面，使车辆通过效率减低；而且摩托车经常在车辆中间突围穿插，极易造成事故。其三，昆明现在大约有75万辆机动车，摩托车大约就接近30万辆，如果3年前就按照逐渐淘汰的办法禁摩的话，可能已经报废掉4-5万辆摩托车了，昆明的交通因为摩托车减少会带来些许缓解。<br /><br />　　以上理由均不能成立。摩托车的行驶安全问题，并不是非要禁摩的理由。汽车同样具有安全问题，纵观 2006年我省发生的各类重大交通事故：４月２日楚雄彝族自治州永仁县永兴傣族乡重大交通事故；３月３１日，昭通市永善县一农用车坠入悬崖，致五人死亡；３月３０日，大理白族自治州鹤庆县发生特大交通事故；３月２８日，昭通市巧家县境内的特大交通事故造成了２８人死亡，３人重伤等交通事故均为汽车造成，汽车撞死人的更多，怎么不禁车呢？如果以后歹徒都开着车抢劫了，是不是就要马路上不许有车的存在了？难道我们能因为刀能伤人就限制或禁止生产刀具吗？安全问题并不是摩托车本身独有的，而且可以通过提高驾驶人员素质、改善路况等多种因素改变，因为安全问题禁摩无疑是因噎废食。<br /><br />　　摩托车使道路资源不能充分利用，为了缓解交通阻塞，禁摩也是是不能成立的，摩托车恰恰有利于交通畅通。大家试想一下，假如全国所有摩托车变换成了小汽车，那么我国所有的城市的交通都要完全阻塞了，因为我国私人摩托车的总量要大大多于私人小汽车的总量。同时摩托车占地小，摩托车和一辆自行车的占地差不了多小，我国的停车场严重不足，这是人所共知的，无论到那个城市停车难都是存在的，如果所有的小车都换成了摩托车，那么停车难就解决了。<br /><br />　　昆明市区目前的行路难是不在于摩托车而在于汽车的发展速度及道路建设的滞后所造成的。昆明市区城市道路的负载能力十分有限，扩路又要受土地资源和巨大开发成本的制约。汽车体积平均是摩托的四倍，在目前行路难的情况下准予摩托车通行也是解决通行快速的一种方法。现在昆明市发展小汽车还只是起步，道路就已经警报频传，要是以后小汽车用户大发展了，在家庭普及了，无疑我们城市的道路只有作汽车停车场的份了。放眼国外，巴黎、伦敦、东京等世界名城，这些城市摩托车行驶自如，既未限，也未禁，更没有摩托车的行驶影响城市交通之说。伦敦市长竟然大力限制汽车，鼓励人们使用摩托车，对骑摩托车的市民实行减税……<br /><br />　　我国公民在法律面前人人平等，交通权不能以车的种类分，为什么要摩托车给小车让路？如果该逻辑成立，以此类推，假设没有了摩托车交通还是不畅，是不是要规定禁止汽车通行防止交通拥挤？是不是要规定一般的小车要给几十万以上的大排量好车让路？如果我们的公路只能让小车走，不让摩托车走；只让大排量的好车走，不让几万元的普通车走，那公路不是成了富人的路了？！昆明现在大约有75万辆机动车，摩托车大约就接近30万辆，如果淘汰的办法禁摩，交通因为摩托车减少会带来些许缓解，哪昆明汽车拥有量有45万辆，远远高于摩托车数量，采用淘汰的办法禁止汽车上路，交通岂不是能因为汽车减少会带来缓解，乃至根本解决交通拥挤？！<br /><br />　　三、“禁摩”严重影响广大中低收入公民权益<br /><br />　　禁摩直接影响拥有27万多辆摩托车的广大市民的就业和生活，以摩托出行，就业半径15公里，范围约175平方公里；以单车或低效的公交系统出行，就业半径为8公里，范围约50平方公里，就业机会就大大减少。城市禁止摩托车行驶，无疑是大大增加了弱势群体的生存和发展成本。另外，城里的小巷和我市郊区农村的乡道交通工具主要是依靠摩托车，很多商品都与摩托车运输有关，如海鲜,菜,水果,零售小商品,送水,送气.摩托车减少以后,这些商品预计将因为没有摩托车造成运输费上涨,供应不足纷纷涨价，结果严重影响到本地人的生活水平。<br /><br />　　从长期来看，禁止摩托车会对我市经济产生大量的负面影响。禁止摩托车造成依赖乘摩托车上下班的人交通费的增加和出行时间加长，物价上涨,生活费提高,而导致低收入的农民工离开昆明，造成民工荒，在长期中恶化投资环境.进而导致潜在的投资者止不不前,已有的投资者会有相当部分转投其他地方。本人大致估计.因此项政策措施直接影响的人口大约有直接50万,占昆明现有人口的1/5.因为物价上涨,间接的影响将涉及每一个人。这样做值不值得？经济学有个基本原理,就是:最好的政府是干预最少的政府,是最小的政府.市场调节常常是最合理的,也是最有效率的。<br /><br />　　在同一个城市生存，与开汽车的相比，骑摩托车的本身就是属于城里经济较弱的群体，生活较为艰辛，理应多得到政府的关心才对。制定城市管理措施应当有利于最广大人民群众的根本利益，而不应当只是为了一部分有钱人（有能力购买使用汽车的人）利益而制定。摩托车主只是机动车主中的穷人，小轿车主则是机动车主中的富贵者。城市管理措施不应在对有限的道路公共资源的分配中明显的倒向富贵者，应考虑各类人群及交通工具的使用者的利益，依据“照顾弱者，方便大众”的原则制定行政规定，而不能采取“限制弱小，保障强权”“劫贫济富”的原则制定行政规定。因我国是社会主义制度的国家。而不是“弱肉强食”的社会。只有兼顾各群体利益，才能保证行人及车辆各行其道，改善道路通行条件。<br /><br />　　四、 “禁摩”将加剧交通拥挤，违背规定初衷<br /><br />　　禁摩的初衷是为了缓解交通拥挤，但是其实施将加剧交通拥挤，违背规定初衷。禁摩后势必会有一部分有条件的人会去买汽车，就更加加重了城市道路的拥挤程度，作保守估计按30%的人禁摩后购置汽车代步，那么，日后起码要增加十万辆汽车。我们可以以现有的汽车加上十万辆新增汽车作个设想，想想都吓人！道路只会越来越堵！反之，如果将现有的小车都换成摩托车呢？那么道路要比现在畅通的多。不说汽车多影响道路通行，反说摩托车多阻路。不是象“下游的羊弄脏上游狼喝的水”的故事吗？道路越紧张，就越要鼓励市民使用轻便的交通工具。　　五、吸取国内外城市管理先进经验，建议“禁摩”为有条件的“允许”　　德国总统最近亲自大力提倡使用摩托、少用汽车，日本为了鼓励少用汽车，方便轻型摩托和自行车停放，还设立了许多可自动升降，电脑管理自动化存取的高架摩托自行车库。国际环保组织也在倡导每年开展无汽车日宣传，而以公交、自行车、低污染摩托代替，我们不能逆国际环保潮流而动啊！同时，我市四区内也存在不少农村地区，经济条件落后，交通欠发达，还未通公交，如西山区马街镇、关渡区大板桥镇，同时，城市交通拥挤现象在某些时段、区域不存在，建议对“禁摩”为有条件的“允许”。<br /><br />例如：　　1、允许二环路以外区域保有摩托车。当前我市交通拥挤主要发生在二环路以内区域，其余城区、郊区交通通行能力依然未能得到利用，如限制摩托车将浪费交通资源。<br /><br />　　2、允许摩托车分时段在市区通行。当前我市交通拥挤高峰主要发生在早上8：00至下午20：00，其余时段交通具备良好通行能力如限制摩托车将浪费交通资源。建议允许摩托车在非交通拥挤时段在市区同行。<br /><br />　　3、允许目前已办理注册登记的摩托车在报废后能够继续更新登记上路。在城市交通工具中摩托车具有独特的优势，是城市交通的有益补充，建议在城市交通工具中通过加强管理。保有摩托车的一席之地。　　在此呼吁各级人大、政协民意机关对予以高度重视，加强对行政规定的监督，维护国家法律的尊严，代表我市27万多辆摩托车的拥有公民的权益。<br /><br />　　呼吁各级政府部门在制定城市管理措施应当切实重视广大弱势群体的权益，真正做到为民办好事、办实事，执政为民。　　呼吁新闻媒体发挥舆论监督作用，就该项新政策征求意见时，多听听有关权益者的声音，真正做到为民说话，为政策制定者反映民意。<br /><br />　　呼吁广大摩友积极采取合理合法的途径、办法，竭尽全力共同维护我们的权益。<br /><br />　　　　　　昆明市一市民 Isn't the vision too common to provok any sense of mercy at the bottom your heart? Frankly, I was, in the first place. The elder gentalment was holding an accordion and playing some pieces of old-fasioned music. He was not intending to attract any walkers' attention but to say, I guess, that "I'm still able to do something" or "I'm still able to hold her hands with my effort". <p> </p><p>The elder blind gentalman who's wearing a faded-gray sun yat sen's uniform standing there to play the music, as if using ten fingers at his full tilt to push the keys. Crow's-feet were being squeezed togather at his canthus when he was trying to sing something out. Maybe he's starving at that time, who knows. The woman who was sitting on a taboret beside singing some blur lyrics out. Two beats were crossing each other and became into a sad feeling. It's so wired that my heart did feel it but no water emerging...</p><p> </p><p>When I was walking by them, she was suddenly turning her gray eyes towards me. The feeling was strange enough! Why she's doing that? Could she see me? But what I did was speeding up my feet and never gave her another glance. Why...?</p><p><br />The traffic corner is oftenly full of students from Yunnan Normal University and Yunnan University, waiting the red light turns to green. As my observation, those who give coins are young ladies. Of course, I gave them some. For 20 minutes, there were no boys or young men donating coins to the blinds. The two elders were expecting it as I did feel the same. It lasted for about two hours, carrying dust and sand from the Sahara across the city. These downdrafts cause descending air to hit the ground and pick up large amounts of dust.</p><br /><p>The gathering dust clouds then travel forward at a speed of 30 mph, creating the frightening spectacle. She was last seen by her flatmate four days before her body was found in the river, Southwark Coroner’s Court heard as an inquest was opened and adjourned today.<br /><br />Coroner John Sampson said: “She went out on the 15th and was reported missing by her flatmate a little bit later when she became concerned after she didn’t return.”Det Insp Andrew Mattrass quashed rumours the student had been pregnant.<br /><br />He said: “It’s not true – I don’t know where that rumour came from. It found that people with higher levels of vitamin D had lower rates of MS. This Mesopotamian culture existed more than four thousand five hundred years ago. In this area that is now Iraq, archeologists discovered fine examples of gold jewelry. Many of the jewelry designs combined the brightness of gold with the intense blue stone called lapus lazuli. With this method, an artist carves the shape of jewelry he or she wants to make out of wax material. It is more like a finger sculpture. She carved the main sterling silver form of the ring from a piece of hard wax material. She also used this milling tool to carve out the areas where she placed small pieces of onyx and jasper stone. Susan Sanders says she is not exactly sure where her ideas come from. Some ideas come from subjects she loves such as modern architecture. style="font-family:arial;">　　假如我是个工人，没有下岗，一个月拿800块钱，不抽烟，不喝酒，不结婚，不吃饭。渴了喝凉水，饿了吃烂菜叶，冷了拣破麻袋穿，总之，一分钱不花，在房价不上涨的前提前，要买那样的房子，得连续工作100年。估计，没什么工厂要这么老的工人。</span><br /><br /><span style="font-family:arial;">　　假如我是个撰稿人，而且混得还不错，每两个字一块钱，我也不抽烟，不喝酒，不吃饭，也不泡文学女青年，要想买那样的房子（同样，房价不上涨），我得连续写2000000字，而且还得保证字字有人要。假如连构思、带写、带修改，每小时可以顺利完成2000字，那么，就得连续写1000个小时，在WORD文档上连续写2000页。我明白了，为什么写字的人容易夭折？憋的。<br />　　假如我是妓女，姿色一般，平均每次收获200块，我也不抽烟，不喝酒，不吃饭，不得性病，不养小白脸，要想买那样的房子（同样，房价不上涨），我得连续接5000次客人。假如每天接客两人（含法定节假日），那得连续奋战2500天，费时7年左右。</span><br /><br /><span style="font-family:arial;">　　假如我是抢劫犯，手段一般，眼神一般，每次出手抢得1000元，我也不抽烟，不喝酒，不吃饭，不找女人，不被抓住，要想买那样的房子（同样，房价不上涨），得连续作案1000次，假如每星期作案一次，那得连续作案18年。</span><br /><br /><span style="font-family:arial;">　　假如我是商人，我连吃带喝，也抽烟，也喝酒，也吃饭，也得性病，夜养小蜜，只要我有本事贷到款，在房子刚出来的时候，噼里啪啦的付上头款，和同伙一起哄抬，不出两年，几套房子就都到手了。</span><br /><br /><span style="font-family:arial;">　　我说这些，并不想发牢骚。我只想说，土地这东西，都属于国家资源，首要的功用，是为这个国家的老百姓提供服务。在合法的政策下，再加上自己的手段，利用国家资源为自己挣钱，这并没有太大的罪过。只是，凡是必须有个度。任何一个国家，两极分化得厉害，都不是个太好的兆头。当一个城市里的大多数人被挤到城市的边缘时，这便是罪过的一种，和英国的圈地运动并不两样。</span><br /><br /><span style="font-family:arial;">　　我们再想一想，两极分化是怎么形成的？看看以上购房的时限，答案就呼之欲出了。一个普通的公民，他辛辛苦苦地工作一辈子，赚得那点可怜的钱，被祖国拿去一部分，被房地产商拿去一部分，最后再被炒房者拿去一部分，这两极要想不分化，也很困难。想想那些在城市里奋斗多年的普通人，几乎大部分人都背上沉重的房贷包袱。这就是大多数人的命运。</span><br /><br /><span style="font-family:arial;">　　我并不是非议国家不可以从土地中获取利益。只是，大众之财，取之于民，用之于民。假如你获取了这些收入，却无法保障大多数人住上满意的房子，那么这"取"，也取得不理直气壮。或许，我这点想法有点愤青，只是，前两天看新闻，都说宪法有进步了，要保护公民的私有财产了。我想，这还是有个因果关系——前提是，你首先得保障大多数百姓拥有一定数量的财产。假如大伙为了一套破房子都累得死去活来，你还有什么好保护的？世界上，没有绝对公正的法律，物质控制能力决定了其走向，我不能说普通百姓就不收益了，然而，在这个法令下受益最大的，是大多数还是少数人？</span><br /><br /><span style="font-family:arial;">　　耕者有其田，居者有其所，这历来都是百姓对于一个国家最起码的要求。不知为何，我突然想起一个例子，记得很不清晰了——似乎是在老俄罗斯，一个穷人没饭吃，偷了一块面包。在当时，这可是大罪。其结局是，他并没有被定罪，原因是，当一个国家无法为其人民提供生存条件，为了生存，他偷窃了，真正有罪的不是他，而是这个国家。</span><div /><br />　　深圳市民邹涛发起的“不买房行动”，据传闻已经遭到封杀，根据一些帖子的说法，邹涛5月11日在深圳机场登机前，即被公安带走。邹涛在天涯的博客“民生观察网”被关闭，邹涛本人也下落不明。<br /><br />　　我以前也预料到会是这个下场，仅仅依靠个人试图影响房地产大鳄以及政府的利益，那无异于痴人说梦。目前深圳、北京的房价的确是非常高，并且有迹象表明有部分购房团在进行人为炒房，从中盈利，地产商也在趁机哄抬房价。但是我们的确没有办法。我们个人可以不买房，也可以发文章谴责这种行为，但是如果组织起数万市民发起某某行为来抵制某某事情，那就触犯了政府的大忌，哪怕你的动机是多么善良和纯洁，你都必然是被封杀的下场。<br /><br />　　“不买房行动”本身来讲似乎只是针对不良房地产集团的行动，但实际上，其已经触犯了政府的相关利益。政府要通过拍卖土地，增加财政收入，当然是卖的价格越高越好；开发商以高成本起步，当然也要追求高回报，何况政府的税收也会因之而水涨船高，在这种政府和开发商双赢的情况下，邹涛同学希望房价降下来，岂不是痴人说梦吗？<br /><br />　　邹涛目前似乎已经离开了深圳，即使他不愿意离开，他的生命可能也会受到威胁，是深圳改变了他，或许他本就不该在深圳这个介于天堂和地狱的城市生存。<br /><br />　　活着深圳就如同活在地狱，教育、医疗、住房三大消费已经成为压在我们头上的“新三座大山”，这三座大山已经压得我们喘不过气来，我们只有依靠拼命地工作而透支自己的生命。死亡也许是我们的唯一出路吧。（例如，我自己的身体状况目前就越来越糟糕，上周公司又进行了例行的身体检查，测量我的血压时候，发现我的低压已经达到了94，属于轻型高血压，看来我又向死亡的不归路上前进了一步。）<br /><br />　　我记得有人说过：“在中国，如果一个纯粹的理想主义者是只有自杀一条路。所以我原来在中国写过一篇文章，叫‘自杀救国’，如果中国人都自杀了，中国的基本问题就算解决了。”<br /><br />　　是的，当我们这些人都死了以后，中国的种种问题就都解决了，这个世界就太平了。（当然，自杀要成功才行，<a href="http://news.163.com/06/0526/02/2I11CCPS0001124J.html" target="_blank">自杀失败了还会被追究刑责的。</a>）<br /><br />　　下面的文章是邹涛5月在凤凰卫视录制的节目，内容来源于<a href="http://blog.sina.com.cn/u/4679dbbf010003ey" />　　昨天下午，赶到中央电视台旁边世纪坛的录音棚，这个录音棚我已去过多次了。中央电视台的《决策者说》、《新闻会客厅》等节目都是在这里录制的。但今天录制的不是中央电视台的节目，而是凤凰台的《一虎一席谈》。最早知道胡一虎是以前在《新周刊》上看过一篇调侃胡一虎与中央电视台主持人的文章，那次对胡一虎的印象很深。所以，虽然今天是我第一次和胡一虎做节目，但却并不感觉到陌生。“不买房运动”的发起人邹涛因为深圳来的飞机晚点了，所以迟迟未到现场，我们谁也不知道他长什么样子，一见门口走进来一位小伙子我们就问他：“你是邹涛吗？”他们都回答不是。直到最后才发现，原来这是导演故意安排的，故意把我们和邹涛分开，避免我们在私底下先聊上了，一旦聊熟了，上台就没有火药味了，节目也就不热闹，不好看了。<br /><br /><br />　　这次节目还请了“集资建房运动”的领袖于凌罡，《安家》杂志的主编刘文斌来到现场，还有一位新认识的朋友叫水木周平，据说他的出名是因为在新浪网上经常写博客骂我和其他房地产发展商。但我从来没有看过水木周平的博客，所以见面后也就跟刚认识一样，没有任何的成见。<br /><br /><br />　　事先凤凰台没有给我们任何资料，也不知道节目中到底要让我们谈什么，到了现场就一切都听导演的安排。先上场的刘文斌和邹涛，我坐在下面观看，后被导演请到他们的控制室去看，在控制室这个小小的房间，里面有十几个荧光屏，不同的机位播放着嘉宾不同的表情，脸部的表情和特征都看得非常的清楚。邹涛语言坚定，短促有力，讲话富有煽动性；刘文斌，首先普通话就没有邹涛好，说话的声音又小。基本感觉还是处在写文章的状态，没有进入做电视的状态。每次讲话时先要说：“我准备讲三点……”，但往往第一点还没有讲完，就被主持人或邹涛打断了。节目里，他由“囚徒困境”理论谈到马克思价值规律中的供求关系，而这些大理论就算在大学的课堂里一时半会也说不清，何况是在电视机上面对千千万万的观众，又在如此短的时间内，想要说清楚实在也是困难。<br /><br />　　接着上场的是水木周平，原本他们安排水木是邹涛的支持者，我想导演可能是为了平衡，但没想到的是水木周平一上台说的第一句话就是：“三年不购房运动是一场胡闹”。这与导演事先的安排完全来了个180度的大转弯，接着又是“阳萎”、“无能”、“伟哥”等说了一大堆现实生活中不怎么经常用的名词。经常上网的人可能比较熟悉这类语言，但在场的年纪比较大的观众，明显感觉到接受不了。<br /><br />　　在他们辩论的过程中，我发现邹涛并没有像他公开先说的那样，因为在节目里首先他说三年内不买房只是一个概念，一年内不买房也可以。另外，他强调的是不要购买奸商的房子，不要购买性能价格比不合理的房子。尤其是最后两条，我想一般的人都会赞同的，因为谁愿意主动去购买奸商的房子，帮坏人赚钱呢？性能价格比不合理的房子其实就是价格明显太高，与房子质量等各方面不相符的房子。提到这次他们搞的运动，我听了半天好像主要是针对政府的，主要希望政府多建一些经济适用房和廉租屋，尤其是针对深圳市政府。其次才是针对房地产发展商的。我认为，市场中每个人都有自己独立的判断和选择，我自己就没有参加任何房地产商的组织。我觉得一个自由的、完全的市场要比受人为操纵的市场、联盟形成垄断的市场公平得多。搞这样的“不购房”运动，运动的发起人和领袖用什么来给他的支持者、参加者承诺呢？如果未来一年也好，三年也好，房价不降反而升了，谁来承担这些参加者的损失呢？所以，我上台后，主持人胡一虎问我如何看待这次运动，我说：“只是说一说吧！市场的问题最终还是要用市场的手段去解决。”这句话不知怎么激怒了邹涛这位领袖。他说：“大家看看，全中国几百万，上千万人关注的，这么大的群众运动，在这位房地产大腕被简单说成‘说一说罢了’”。接着他又质问我：“你给政府官员行贿受贿了吗？你偷税漏税了吗？”我告诉他：“没有。”我们公司的基本原则是不做一分钱的假帐，不偷税漏税一分钱。在我们公司，所有的报销是不允许报销任何卡拉OK、KTV、桑拿按摩的凭证票据的。我说完后，邹涛立即说：“北京的网民：你们谁发现他有行贿受贿和偷税漏税的行为，马上用电子邮件的方式向我报告。”，邹涛讲话的口气俨然一副领袖的派头。我真心的欢迎全社会来监督我、我们的公司和我们公司的每一个员工的行为。接着他又喊了一句：“你们一定会受到人民的审判的！”我问他：“你说的‘你们’是谁？你能代表人民吗？”他并没有回答我问题，他说这次运动已经取得了第一阶段的胜利，就是在全中国已建立了36个工作站，深圳市的领导已经接见了他。广东省国土局的局长也从不同角度响应了他们的运动，提出来并呼吁市民“三年内不要买房”。这次他来北京，主要是见中央领导的，见中央领导的消息不是我在现场得知的，是在《南方都市报》上看到的。<br /><br />　　邹涛又在喊“正义一定战胜邪恶！”的口号了。场上一阵混乱，有位邹涛的忠实的支持者向邹涛鞠了一个90度的躬，向他表示敬意。邹韬起身也向他鞠了90度的躬表示回敬。当时，胡一虎问我有什么看法。我说，“我正在想谁是正义，谁是邪恶，没有注意听他们在表演时都说了些什么。”<br /><br />　　中场休息后，于凌罡上场，与过去两年他的表演一样，在不断地推销“集资建房”的伟大蓝图，不断地说“我们要团结起来！”，“正如邹涛先生说的，团结就是力量！”听到这里，我忍不住插话说：“那是毛主席说的！”。<br /><br />　　团结的确是个美好的词语，但不同的人有着不同的理解。邹涛和于凌罡的理解，团结就是把购房人团结起来，向其他人作对，向其他人斗争，进行一次运动，而这样运动的实质其实是不团结，团结在这里成了一种手段，达到的目标也是不团结，只是一场斗争。至此，我对团结的含义有了进一步的理解，忽然明白为什么许多伟人都说“团结是全人类的团结，是天下一家，是世界和平”，总认为自己是对的，正义的，而别人是错误的，邪恶的，这才是团结道路上最大的敌人。小范围内的团结，不是真正意义的团结，它往往会成为纷争和斗争，甚至战争的根源。真正的团结需要自身不断的反省和与他人友好的磋商精神。<br /><br />　　如同战争牺牲的是社会中最年轻、强壮和勇敢的生命，而历史上一次又一次的群众运动，首先摧毁的是长期积累下来的精神财富，其次是物质财富。用自私摧毁爱心；用野蛮摧毁文明；用政治口号摧毁理性思考……为了避免这种灾难性运动的发生。我们的社会一定要减少官僚主义和腐败，关心人民的困难和疾苦；社会各阶层尤其是商人，要尽可能的做一些善事。社会的贫富两极分化、官僚主义和腐败，是这些具有破坏性运动的根源。而这种运动的根源绝不因为是出了一个、两个邹涛。房地产在近一、两年来，是社会矛盾的焦点，这是几年来许多的原因形成的，而化解矛盾，处理好这些问题是需要全社会用理性共同来解决的。市场上供求关系的平衡就是市场经济中最大的和谐，供求关系出现不平衡就需要及时的去调整。本位主义、互相推诿、指责对方只能耽误问题的解决和激化矛盾。<br /><br />　　目前房价的暴涨已经是大家看到的事实，有些部门却还在争论到底是6％，还是17％，各说各的道理，随便在市场上走一走，看一看就知道。有些房地产发展商也是掩耳盗铃，不愿意承认目前的事实。房价暴涨有一部分原因是房地产发展商囤积土地和房子，这也是不争的事实，政府应该严格执行过去的法律，把两年不开发的土地收回。法律的规定是无偿收回，哪怕给这些开发商付一些成本钱，也比把土地囤积在他们手里不开发要好得多。<br /><br />　　任何人，任何行业都会面对一些挑战，邹涛的出现并不可怕，他喊几句过激的口号，我认为没有什么危险。让大家和全社会都来监督房地产行业，只能使这个行业更健康的发展，最可怕的没有人来监督。社会上不是还有人绝食吗，有人自焚吗，比起这些极端的行为邹涛的行为理智多了。危险的是我们自己房地产商在这特别时期，应该尽快拿出囤积的土地来建房子，不要只做地产商，而要做房产商。社会对我们回报一定是我们对社会贡献的体现，坐在土地上像老地主一样等到土地升值，不动一砖一瓦就想赚大钱，获暴利，这种事情是不会长久的。当你不愿意再干活时，不愿意再建房子时，“无形的手”会收回你再干活，再建房子的权利和机会。<div
